Privacy
This policy explains what information PaceReset collects, why, and what your rights are. PaceReset is operated as a sole-trader business by David Kearney, trading as PaceReset, based in the United Kingdom. We are the data controller for any personal data described below. You can reach us at hello@pacereset.com.
What we collect
- Newsletter sign-ups — your email address, the date you subscribed, and (where relevant) which signup form you used. Provided directly by you.
- Order data on Etsy — handled by Etsy, not us. We see only what Etsy shares with sellers (your buyer name, the product purchased, and the email Etsy uses for delivery). See Etsy's own privacy policy for what they collect on you.
- Email correspondence — if you email hello@pacereset.com we keep a record of the message until the matter is closed and for a reasonable period afterwards.
Why we collect it & legal basis
- Newsletter — to send you updates about PaceReset products, articles, and offers. Legal basis: your consent (you signed up). You can withdraw consent at any time using the unsubscribe link in any email.
- Orders — to fulfil the purchase, provide customer service, and meet our tax record-keeping duties. Legal basis: contract and legal obligation.
- Email correspondence — to respond to your enquiry and improve our service. Legal basis: legitimate interest.
Who we share data with
We use a small number of trusted services to run the business. Your data may be processed by:
- beehiiv — newsletter delivery (US-based, ICO-recognised standard contractual clauses for international transfers)
- Etsy — marketplace sales and order processing
- Cloudflare — website hosting and DNS
- Spaceship — domain registration and email forwarding (if you email us at our domain)
- HMRC — for tax compliance, where required by law
We do not sell your data. We do not share it with anyone else without your consent except where required by law.
How long we keep it
- Newsletter subscribers: until you unsubscribe, then deleted within 30 days.
- Order records: 6 years from the end of the tax year of the transaction (HMRC requirement).
- Email correspondence: typically 12 months unless we have an active matter open.
Your rights
Under UK GDPR and the Data Protection Act 2018 you have the right to:
- Ask what data we hold about you (subject access request)
- Have inaccurate data corrected
- Have your data deleted (subject to our legal record-keeping duties)
- Restrict or object to how we process your data
- Receive your data in a portable format
- Withdraw consent for marketing at any time
To exercise any of these rights, email hello@pacereset.com. We respond within one calendar month.
Complaints
If you believe we have mishandled your data, you can complain to the UK Information Commissioner's Office at ico.org.uk. We'd appreciate the chance to address it first — please email us before escalating.
Terms
About these terms
These terms govern your use of pacereset.com and any product you buy from us. By using the site or buying a product you agree to them. They are governed by the laws of England & Wales, and any dispute is subject to the exclusive jurisdiction of the English courts. Nothing in these terms removes your statutory consumer rights.
About us
PaceReset is operated by David Kearney as a sole trader, based in the United Kingdom. Contact: hello@pacereset.com.
Use of the site
You may use this site to browse our products, read our content, and sign up for our newsletter. You agree not to attempt to access systems you are not entitled to, scrape content at scale, or use the site in any unlawful way.
Products & orders
Our products are digital downloads: PDFs, audio files, or other files delivered electronically once payment is confirmed. Currently they are sold via the Etsy marketplace; orders, payments, and delivery on Etsy are governed by Etsy's own policies in addition to these terms. When we add direct sales (via Stripe) we will update this section.
Prices are shown in pounds sterling and are inclusive of VAT where applicable. We may change prices at any time, but the price you see at checkout is the price you pay.
Intellectual property
Everything on this site and inside our products — text, design, photography, code, the PaceReset name and the sunrise mark — is owned by us. When you buy a product you receive a personal, non-transferable, non-exclusive licence to use it for your own personal use. You may not redistribute, resell, or share the files without our written permission.
Disclaimer & limitation of liability
Our products provide general wellness and lifestyle information. They are not medical advice. If you have a health condition, are pregnant, or are taking medication, please consult a qualified medical professional before changing your routine.
To the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the site or products. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be limited under English law.
Changes
We may update these terms from time to time. The "last updated" date at the top of this page reflects the most recent change. Continued use of the site after a change means you accept the updated version.
Refunds
Under the UK Consumer Contracts Regulations 2013 you have a right to cancel a purchase of digital content within 14 days of placing the order — unless you have given us your explicit consent to begin the download immediately and acknowledged that doing so ends the right to cancel. On Etsy, instant-download products carry that consent flag; once you download the file, the cancellation right falls away.
If a file is faulty, the wrong product was delivered, or you have any other issue with your order, email us at hello@pacereset.com and we will sort it. We aim to respond within 2 working days.
If you have any question about any of the above, email hello@pacereset.com.
